Scary's Former Hubby is Not So Nice Spice

TMZ has learned that a custody battle has erupted between Mel B and her former husband over their almost 9-year-old daughter, Phoenix, and whether mom can take her on the road. Can't take my baby, Spice!

We're told dancer Jimmy Gulzar refused to alter his visitation schedule with the working mom -- and custodial parent -- Scary Spice aka Melanie Brown, while she's on tour with the Spice Girls. Now TMZ has obtained documents supporting Brown's desire to take Phoenix on the road with her. Los Angeles County Superior Court Judge Robert Schnider has ordered that little Phoenix can go on the road with her mom as she tours the world, thus denying Gulzar's attempt to block her from traveling. Your mum's your best friend!

Mel, who is represented by powerhouse attorney Goldie Schon, still maintains sole legal and physical custody of Phoenix, and Gulzar will have scheduled visitation over the next few months and on the little girl's birthday.

33. This lady has been thru so much. Eddie Murphy did what he could to humiliate her. He 'forgot' he knew her intimately? I lost all respect when he denied the child was his. She is a woman who had a baby out of wedlock, so what. No abortion! I applaud her. She has taken care of her 9 year old 9 years hasn't she?

34. THis child needs to stay here with her Father. This is not right for the woman to have sole custody, and take the child from hence would make visits hard for both. Unfair... I am a woman, however I do understand how some women get back with children. Which I think should have charges of child endangerment or abuse charges filed if this were the case.

This child did not ask for Mommie to go back on tour after retirement. She needs her father in her life. With today's society breakdown. We need more fathers who will step up!

37. This is such a bogus attempt to use custody of children as a pawn in the courts out of spite. They have toddlers and little kids with them, for freak's sake!! How wild can that tour get??? Providing the child an opportunity to travel the world--omg the poor thing will just be scarred forever, how will she ever recover? (For the dim-witted out there, that last sentence is dripping with sarcasm, a sad fact I have discovered is actually necessary to point out.)

Yeah, he's "stepping up" about as much as Howard K Stern, and Larry Birkhead. For the sake of the child alone. I have some swampland in the middle of Arizona you might be interested in. Or, how about the Brooklyn Bridge? Wouldn't that just look fabu in your yard?

41. I don't have kids nor do I want any but I agree with the others on this board about Mike and Jizy. It isn't kids that mess everything up, its the adults that brought them into this world that messes the world up! They didn't ask to be here, we brought them here. And while they are eventually held responsible for their actions, their parents have to share some blame for not raising them right in the first place!

As I said, I don't have kids nor do I want any (at least right now) BUT to say that kids mess up everything is a very ignorant statement.

42. On the subject at hand, we don't know why this situation is the way it is. I do know that often in these cases, the woman has the upper hand concerning kids in court. The man often gets screwed over whether he deserves it (which some do) or not. Plus, why would you want to take your daughter on tour with you? Assuming he isn't a pyscho or abusive to the kid, it would make more sense to leave the kid with her father while on tour.

People say this is a man's world. By in large, it is and that isn't fair but there are some things that the woman has the upper hand and that's not fair either.

43. Am I the only one thinking most of the comments on this story would be different if Scary Jr was acyually a 9-month-old baby? Because I'm pretty sure she isn't 9, and the author did a typo. I can't see any reason that the baby shouldn't go on tour... I mean think o how many mums and dads have no choice but to have someone take care of baby from 9 to 5... How would being on tour be diferent?
